The statements are entirely compatible - the accident caused by the blowout may not be under the control of the driver, but the tyre manufacturing fault is caused by the manufacturer, the debris is down to whoever left it where it could be blown on to the road, and the pothole is down to poor planning of maintenance by the highway authority. But these may not have legal liability, if the foreseeability of the accident was too remote, or the manufacturing/inspection regime was deemed satisfactory. Peter. |
